<p> Maryland product liability lawyer Robert K. Jenner today applauded the Federal Trade Commission for getting Skechers, USA, Inc., to agree to pay a $  40 million settlement in response to charges that the company made deceptive claims about the health and fitness benefits of its Shape-Ups, Resistance Runner, Toners and Tone-Ups toning shoes.</p>
<p>&#13;</p>
<p>The complaint and proposed settlement were filed in the U.S. District Court for the Northern District of Ohio on May 16, 2012 (Docket No. 1:12-cv-01214-JG).</p>
<p>&#13;</p>
<p>Jenner, a partner with the Maryland personal injury firm of Janet, Jenner &amp; Suggs, LLC, currently is serving as Co-Lead Counsel in a separate action for all plaintiffs who have filed federal court lawsuits against Skechers for injuries alleged to have been caused by the same brand of rocker bottom toning shoes. </p>
<p>&#13;</p>
<p>Kentucky attorney Ronald E. Johnson Jr. of Schachter Hendy &amp; Johnson, PSC, is serving as the other Co-Lead Counsel in the ongoing Skechers multidistrict litigation case in the U.S. District Court for the Western District of Kentucky in Louisville (MDL No. 2308).</p>
<p>&#13;</p>
<p>“This settlement announcement should now focus consumers’ attention not only on their ability to get a well-deserved refund but also on their physical health,&#8221; Jenner said. &#8220;We contend that these shoes have caused a litany of health problems, including snapped bones, ripped Achilles tendons and ligaments and stress fractures of the feet, knees and hips.”</p>
<p>&#13;</p>
<p>The FTC announced the settlement on Wednesday, May 16, 2012, regarding charges that Skechers deceptively advertised that its Shape-Ups would help people to lose weight and strengthen and tone their buttocks, legs and abdominal muscles. To make a claim for a Skechers refund, consumers are directed to the FTC&#8217;s Skechers settlement website.</p>
<p>&#13;</p>
<p>The settlement will allow consumers who bought the toning shoes to collect refunds either directly from the FTC or through a court-approved class-action lawsuit, according to the FTC.  </p>
<p>&#13;</p>
<p>The settlement also bars Skechers from making future claims about certain health and fitness benefits of the shoes “unless they are true and backed by scientific evidence.”</p>
<p>&#13;</p>
<p>In September 2011, the FTC reached a $  25 million settlement with Reebok over similar charges that it had made deceptive claims about the health and fitness benefits of its toning shoes. </p>
<p>&#13;</p>
<p>In a press conference, the director of the FTC’s Bureau of Consumer Protection, David Vladeck, said the higher dollar amount of the Skechers settlement reflected the company’s share of the toning shoes market and the number of consumers potentially impacted.</p>
<p>&#13;</p>
<p>“Skechers’ unfounded claims went beyond stronger and more toned muscles. The company even made claims about weight loss and cardiovascular health,” Vladeck said. “The FTC’s message, for Skechers and other national advertisers, is to shape up your substantiation or tone down your claims.”</p>
<p>&#13;</p>
<p>Johnson pointed out that the FTC’s settlement does not address injuries allegedly caused by the shoes, which is the focus of the ongoing litigation in the Western District of Kentucky.</p>
<p>&#13;</p>
<p>According to court documents, the plaintiffs claim that they have sustained injuries from Skechers “Shape-Ups” toning shoes due to the shoes’ rocker bottom sole. They claim that the design altered their gait and caused severe lateral instability.</p>
<p>&#13;</p>
<p>Johnson cited a May 2011 Consumer Reports article stating that toning shoes had produced more injury reports than any other product in its database. </p>
<p>&#13;</p>
<p> “The FTC settlement, in our view, supports our key allegations that these shoes have not conferred any health benefits at all while, at the same time, they have exposed thousands of people across the country to the risk of serious injury,” Johnson said.</p>
<p>&#13;</p>

<p> With media reports of suicide among lesbian, gay, bisexual and transgender (LGBT) youth becoming increasingly common, communities are grappling with the urgent need to identify interventions to prevent suicide and suicidal behavior among LGBT youth. However, until today, no “Best Practices” have been identified or designated to help reduce vulnerability and risk among LGBT children, youth or adults.</p>
<p>&#13;</p>
<p>Although recent media attention has focused primarily on the impact of bullying on self-harm behavior. suicide is typically the result of many interacting factors including depression, substance use and despair, in addition to environmental stressors. These complex interactions underscore the need for comprehensive suicide prevention strategies and interventions to change the environment at the systems level. For LGBT youth, family systems are especially important.</p>
<p>&#13;</p>
<p>For the past decade, the Family Acceptance Project (FAP) at SF State University, under the direction of Dr. Caitlin Ryan, has been studying the impact of family acceptance and rejection on suicide risk among LGBT youth. Published findings from these studies point to the critical role of families in both contributing to and protecting against suicidal behavior and risk among LGBT young people. FAP’s multi-disciplinary team has been developing resources, interventions and strategies to help diverse families reduce risk and to promote their LGBT children’s well-being. </p>
<p>&#13;</p>
<p>The first of these resources – a multi-lingual, multi-cultural series of family education booklets – Supportive Families, Healthy Children: Helping Families Support their LGBT Children – have been designated as the first “Best Practice” resources for suicide prevention for LGBT youth and young adults by the national Best Practices Registry for Suicide Prevention. </p>
<p>&#13;</p>
<p>Coordinated by the Suicide Prevention Resource Center (SPRC) and the American Foundation for Suicide Prevention (AFSP) and known as the “SPRC/AFSP Best Practices Registry for Suicide Prevention,” the registry designates and maintains an expert-reviewed compendium of approved “best practices” to prevent suicide, all of which address specific aims of the national suicide prevention plan and have met objective criteria based on accuracy, safety, likelihood of meeting suicide prevention objectives, and adherence to prevention guidelines.</p>
<p>&#13;</p>
<p>Available in specific cultural versions in English, Spanish and Chinese, Supportive Families, Healthy Children education booklets were developed based on extensive research and direct feedback from families, LGBT youth and the providers who serve them. The booklets help ethnically and religiously diverse families understand how specific reactions to their children’s LGBT identity both contribute to and protect against risk for suicide and related health problems. Research-based guidance for families is depicted non-judgmentally using personal stories, lists of behaviors that both protect against and are related to high risk for suicide and other serious health problems, and approaches to decrease family conflict and to increase support. FAP’s core research and family education materials were supported by The California Endowment, a health foundation dedicated to expanding access to affordable, quality health care for underserved individuals and communities.</p>
<p>&#13;</p>
<p>Said, Dr. Caitlin Ryan, Director of the Family Acceptance Project:  “Our work is grounded in rigorous research and rooted in the cultural experiences and values of scores of diverse LGBT youth and families. So these family education booklets resonate for very diverse families and help them decrease rejecting behaviors which our research shows &#8212; though motivated by care and concern – instead contribute to serious health risks for LGBT young people. For example, our research shows that common rejecting behaviors such as trying to prevent LGBT youth from learning about their identity, not allowing them to have gay friends or not letting them participate in an LGBT youth group are related to a 9-times greater likelihood of attempted suicide.”</p>
<p>&#13;</p>
<p>In discussing the importance of FAP’s family education materials, Dr. Ann Haas, Director of Prevention Projects for the American Foundation for Suicide Prevention, noted:  “For the past decade, Dr. Ryan and her team have undertaken foundational research on the role of families and related social institutions in contributing to protective factors and risk for suicidal behavior among LGBT young people. They have turned that research into powerful prevention tools for diverse families. Used in programs across the country, these tools will save lives.”</p>
<p>&#13;</p>
<p>More than 100,000 copies of the family education booklets have been disseminated across the U.S. and other countries for use in schools, primary care and behavioral health programs, foster care and juvenile justice services, family service agencies, suicide prevention programs, and in pastoral counseling and faith-based organizations. Additionally, the booklets are used in colleges, universities and professional training programs and by government agencies. &#13;<br />
<br />Agencies and community groups that use the Family Acceptance Project’s “Best Practice” materials and family intervention approach report substantial positive changes in prevention and practice:&#13;<br />

     Jerry Peterson, coordinator for a Contra Costa County, CA mental health support initiative for LGBT youth said:  “FAP’s research is the cornerstone of our work in Contra Costa County.  These booklets are a critical education and prevention tool that not only help prevent depression and suicide, but also help prevent substance abuse, sexual health risks and expulsion and removal from the home. FAP’s inherently respectful approach strengthens families and helps build a gay or transgender child’s sense of self-worth – in the context of their families. This is especially important for LGBT youth of color.” &#13;</p>
<p>     Greater Boston PFLAG President, Stan Griffith, whose chapters have worked with the Massachusetts Department of Public Health and other groups since 2007 to disseminate FAP’s family intervention approach and materials across the state noted: “The Family Acceptance Project’s research and family support strategies that show the crucial role of family acceptance have caused us to totally rethink the way we approach our work. We now know that it’s essential for every parent – and every prospective parent &#8212; to have this information. Supportive Families, Healthy Children is an indispensable part of every individual or group conversation with parents and caregivers and with professionals who provide counseling, health and other services to children, youth and families.” &#13;</p>
<p>     Theresa Nolan, Division Director of Green Chimneys NYC, said:  “The Family Acceptance Project has pioneered a culturally grounded approach to help diverse families support their LGBT children. In NYC, FAP’s research-based strategies, family education booklets and other tools are helping us implement one of the first family intervention programs for LGBT homeless youth. <p> Prior to the elections in Serbia during first week in May, South East Europe and the Slovenia Millennium Project Node chair Blaž Golob visited Belgrade to meet with the President of Serbian Association for Information Society Professor Miodrag Ivković. During the visit on April 26th MOU between MP (Director Jerome C. Glenn) and Serbian Association for Information Society (President Professor Miodrag Ivković) was signed.</p>
<p>&#13;</p>
<p>The meeting in Belgrade followed the expression of interest of Serbia in becoming a Millennium Project Node during the Renaissance for eGovernance event in March, 2012 held in Ljubljana, Slovenia. During this unique conference on future forms of governance, Jerome Glenn, Executive Director of The Millennium Project, explained how collective intelligence systems could improve transparency, accountability, citizens’ participation, and knowledge-based governance. This presentation triggered the interest of several South East European countries to become actively involved in The Millennium Project. Serbia is the third country in the region, after Slovenia and Montenegro, to become an active member of the Millennium Project. </p>
<p>&#13;</p>
<p>The Node in Montenegro chaired by Mr. Milan Marić was the first country in the region to translate and publish the 2011 State of the Future.  The Slovenian Node with its annual foresight “Bled forum on the future of Europe” was established in 2006.  The annual Bled Forum and the Center for eGovernance Development for South East Europe (Public Private Partnership institution) are the key mechanisms that bring together all South East Europe countries together to share methods and concepts to improve governance, foresight, and information society.</p>
<p>&#13;</p>
<p>The 2011 State of the Future is a summary of our overall situations, problems, solutions and prospects for the future, from the 15 Global Challenges. These include energy, food, science and technology, ethics, development, water, organized crime, health, decision making, gender relations, demography, war and peace, and others. The recommendations are specifically targeted to senior executives, thought leaders, strategic planners, public policy experts, political advisors, non-profit organizations, teachers / professors and anyone interested in an overview of our prospects for the future. This report analyzes a wide range of policy initiatives geared toward the future, such as: potable water, seawater-based agriculture, environmental safety in the central United States and China, strategic trust, a comprehensive strategy to combat organized crime and collective intelligence.</p>
<p>&#13;</p>
<p>According to Jerome Glenn, executive director of the Millennium Project and one of the authors of the report, there is room for optimism: &#8220;If we can improve our decision making as individuals, groups, nations, and institutions the world will be better than it is today&#8221;.</p>

(EIC) is excited to announce that a recent White House event, which featured a panel of trailblazing women in Science, Technology, Engineering and Mathematics (STEM) fields, is now available for viewing online. At the April 24 event, sponsored by the White House Council on Women and Girls, young women who have studied and worked in STEM fields encouraged girls to follow in their footsteps – or blaze trails of their own. The event also featured the first public screening of “Girls in STEM,” a short video about girls who participated in the 2012 White House Science Fair. </p>

<p>Women and girls continue to be significantly underrepresented in the STEM fields – a trend that starts early and comes at a serious cost to both the career prospects of our young women and the success of our economy.  By ensuring women and girls receive the exposure, encouragement and support they need to enter and succeed in STEM fields, this country can benefit from the full range and diversity of its talent.</p>

<p>As announced in conjunction with the event, Entertainment Industries Council, Inc. (EIC) has organized a collaboration to support the promotion of girls and women to enter education and career paths within the fields of science, engineering and technology. Collaborators include:  EIC, the esteemed organization providing creative resources to entertainment writers about key issues affecting society, which also produces the unique Science, Engineering and Technology (SET) Awards that recognize entertainment program stories that further public understanding of these fields; International 3D Society, founded to advance the art and technologies of stereoscopic 3D content and its professional innovators; Women In Film, dedicated to helping women achieve their highest potential within the global entertainment, communications and media industries and to preserving the legacy of women within those industries; and the Visual Effects Society, with a mission to educate and develop public awareness and understanding to support and encourage technological advancements in the field of visual effects. The reach of these organizations within the entertainment industry workforce from writers, producers, directors, to 3D engineers, and visual effects model makers, and technologists including entertainment from film, television, music videos and game industries creates an opportunity for aspiring girls and women to discover future employment opportunities within the evolving technologically advanced aspects of the entertainment industry of the future. The collaboration will work together to host creative briefings for entertainment industry networks, studios and production companies that accentuate the role of women and technology, engineering and science. </p>

<p> Seventy-five percent of parents say teaching children how to use personal audio technology safely should be a major health priority, according to results of a new online poll commissioned by the American Speech-Language-Hearing Association (ASHA).</p>
<p>&#13;</p>
<p>One thousand parents with children age 18 and under at home took the poll this past March. It defined “personal audio technology” as devices where headphones or ear buds are used (iPods, other MP3 players, cell phones, computers, and the like). Crux Research created the poll content in consultation with ASHA, while the survey firm Toluna fielded the poll.</p>

<p>The parental call to make safe listening education a major health priority apparently stems from other poll findings like these:&#13;<br />
</p>
<p>&#13;<br />
     42% of all parents polled feel their children use personal audio technology at volume levels that could potentially harm their hearing; the same worry is shared by more than half of the parents of boys ages 13-18 and nearly of half of the parents of girls the same ages.&#13;</p>
<p>     43% of parents of boys ages 13-18 and 42% of parents of girls the same ages say their children use personal audio technology more often than they like.&#13;</p>
<p>     84% of all parents polled say they are concerned that misuse of personal audio technology is damaging the hearing of children in general; within that group of parents, nearly 50% say they are extremely or very concerned; meanwhile, for the same reason, more than half of all minority parents polled say they are extremely or very concerned for the hearing of their children (this finding is most pronounced among Hispanic parents, 63%; African American are next, 50%).
<p>On average, parents think children should be about age 11 before they have unsupervised use of personal audio technology. </p>
<p>&#13;</p>
<p>“We have long been aware of the potential for noise-induced hearing loss caused by the use of excessive volume and frequent and prolonged listening time,” ASHA President Shelly Chabon, PhD, CCC-SLP says. “However, there is a dearth of documentation focused on moms’ and dads’ opinions about poor listening habits. <p> Headaches are among one of the most common disorders of the nervous system and accounts for thousands of doctor visits in the United States each year. The painful throbbing experience from a headache can seriously impede on a person’s normal function and is one of the more common reasons for absence from work or school.  Many Americans experience chronic or daily reoccurring headaches and feel that pain pills are the only thing for relief.</p>

<p>There are two common types of headaches, which are migraines and tension headaches. </p>

<p>According to the World Health Organization, tension type headaches occur in over 80% of women and 65% of men. This condition is characterized by bilateral to moderate pain and pressure which is often described to having pressure or tightness around the head which can spread from or into the neck. These painful headaches are caused by tension of the neck muscles and can result from excessive forward head posture, which is a common problem with people who work on a desk.</p>

<p>Migraines are an inherited neurological disorder that is characterized by hyper-excitable networks in the brain that may have been triggered either by a stimulus or spontaneously, leading to attacks. These attacks may also be associated with sinus pain, anxiety, vomiting, sensitivity to light, difficulty with concentration and mental processing, and changes in the mood. Typically, migraines tend to last for 24 hours and may last up to 3 days.  </p>
<p>&#13;</p>
<p>Both migraines and headaches can result from many different sources and have triggers such as stress, diet, chemical imbalances and misalignments of the cervical spine.  Chiropractic care refers to these spinal misalignments as subluxations, which can cause nerve interference in the body. Subluxations can occur from various causes such as automobile accidents, repetitive movements, poor posture, poor ergonomics or lack of exercise.
